About Saaph
Saaph is operated by Saaph Commerce Limited, a company based in Nairobi, Kenya. Saaph is a goal-led transformation platform where people document personal journeys, discover products through real experiences, and connect with businesses that help them achieve meaningful goals. By accessing or using Saaph, you agree to these Terms of Service and our Privacy Policy.
Eligibility

You must be at least 17 years old to create an account or use Saaph. By using the Platform, you confirm that you meet this requirement and have the legal capacity to enter into this agreement.

Your Account

You are responsible for maintaining the security of your account and any activity that occurs under it. You agree to provide accurate information and to use Saaph in accordance with these Terms.

Content You Share

You retain ownership of the content you create on Saaph. By posting content, you grant Saaph permission to display, distribute, and promote that content within the platform for the purpose of operating and improving the service. You are responsible for ensuring that the content you upload is accurate and that you have the necessary rights to share it.

Products and Recommendations

Saaph allows creators and businesses to tag products within journeys. Product availability, pricing, shipping, warranties, and returns are determined by the relevant seller unless stated otherwise. While we work to maintain accurate information, Saaph cannot guarantee that every product listing remains current at all times.

Purchases

If you purchase products through Saaph, payment, delivery, refunds, and order fulfillment may be handled either by Saaph or by participating vendors depending on the specific transaction. Any additional terms presented during checkout form part of your purchase agreement.

Points and Rewards

Saaph may award points or other incentives for participating in journeys or engaging with the platform. These rewards have no cash value unless explicitly stated and may be modified or discontinued at any time.

Acceptable Use

You agree not to:

  • Post misleading or fraudulent content.
  • Upload content that infringes the rights of others.
  • Manipulate reviews, journeys, or engagement.
  • Use Saaph for unlawful purposes.

We may remove content or suspend accounts that violate these Terms.

Acceptable Use Policy — Marketplace Partners

Applies to: Saaph Marketplace (partner-supplied products). Saaph-branded direct sales are governed by the remainder of these Terms.

X.1 Partner Eligibility & Good Standing

Marketplace Partners/Vendors must complete and maintain accurate KYC information (business registration, KRA PIN, director ID, verified payout account) as a condition of remaining active on the platform, hold all licenses required by Kenyan law for the products they sell, and keep contact, banking, and business details current.

X.2 Prohibited Products

The following may not be listed or sold on Saaph Marketplace: counterfeit or unauthorized-branded goods; products requiring a license or regulatory approval the Partner does not hold; stolen or unlawfully obtained goods; recalled, expired, or unsafe products; goods prohibited under Kenyan import/export law; items infringing third-party intellectual property.

X.3 Product Listing Standards

Partners must provide accurate product descriptions, images, pricing, and stock availability; correctly map products to the goal(s) they claim to address; and disclose accurate lead times.

X.4 Prohibited Partner Conduct

Partners must not circumvent Saaph's payment flow, contact buyers to resolve disputes outside Saaph's process, manipulate reviews or platform metrics, misuse Saaph's or another Partner's/Vendor's branding, or engage in conduct that brings Saaph or the Marketplace into disrepute.

X.5 Fulfilment Obligations

Partners must fulfill orders within the disclosed lead time and routing (direct, checkpoint, or consolidated), and package goods to withstand ordinary transit and applicable checkpoint handling.

X.6 Enforcement

Saaph may, depending on severity: issue a warning; withhold or freeze pending payout during investigation; suspend a listing or storefront; permanently remove a Partner/Vendor; or report unlawful conduct to relevant authorities.

Saaph's Intellectual Property

The Saaph name, logo, branding, and platform design are the property of Saaph Commerce Limited. Nothing in these Terms grants you rights to use our trademarks or copy the platform's design or functionality.

Termination

We may suspend or terminate your account if you violate these Terms. You may stop using Saaph and request account deletion at any time in accordance with our Privacy Policy.

Platform Availability

We strive to keep Saaph available at all times but cannot guarantee uninterrupted access. Features may change as the platform evolves.

Limitation of Liability

To the fullest extent permitted by law, Saaph is not liable for indirect, incidental, or consequential losses arising from your use of the platform. Our liability is limited to the amount you paid directly to Saaph for the relevant service where required by law.

Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of Saaph will be subject to the exclusive jurisdiction of the courts of Kenya.

Privacy
Your use of Saaph is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
Changes to These Terms

We may update these Terms from time to time. Continued use of Saaph after changes become effective constitutes acceptance of the updated Terms.
